High Court has declined to summon Kampala Minister Beti Kamya. High Court judge judge Henrietta Wolayo informed Kampala Lord Mayor Erias Lukwago that his application had been turned down. The judge after hearing out the application said the minister can only come to court if she wills.
Wolayo ruled “In this circumstance, the court cannot compel the minister but she can come voluntarily during the next sitting and if she doesn’t then court will go on to hear the case without her.”
The Lord Mayor Erias Lukwago applied for summons to have the minister come for cross examination in relation to an affidavit that she swore in response to the suit against her. Lukwago raised five areas of contention where they need the minister to explain herself including giving reason why she declared meetings by the lord mayor illegal and issued a ban on the lord mayor’s travel abroad.
Lukwago noted that, “We need the minister summoned to explain why she usurps powers of the lord mayor when she has ministerial powers.”
However, Kamya’s lawyer Macdusman Kabega objected to the summons saying all the areas of contention were responded to by way of an affidavit and there is nothing to be clarified. He says the minister only took decisions as empowered by the KCCA act.
Lukwago accuses Kampala and KCCA ED Jennifer Musisi of refusing to resolve differences they have with him legally.
Lukwago said he is ready to pursue the full legal process of this matter although he has a previous legal matter in which the high court ordered that he be paid over 600 million shillings which orders have never been followed through.
The matter over power will return to court on the 31st august 2018.
