Kanyamunyu murder case hearing fails to kick off

Hearing of the murder case against brothers Mathew and Joseph Kanyamunyu together with Mathew;’s girlfriend Cynthia Munwangari has failed to kick off at the High Court in Kampala.

The trio is accused of shooting dead Kenneth Akena on November 12 , 2017 after scratching Mathew Kanyamunyu’s car along Jinja road.

On Monday, the Director of Public Prosecutions represented by Fatina Nakafeero told court that she could not proceed with hearing of the matter because she had no disclosed her evidence to the defnce lawyers.

“I cannot proceed to present witnesses without undergoing this requisite pre-trial step,”Nakafeero said before asking court to adjourn the case to the next session hoping that  by then she would have been able to disclose all the evidence and exhibits to the defence team led by Macdusman Kabega.

Consequently, Justice Steven Mubiru   pushed the trial to the next convenient criminal session after explaining that he cannot find another date to fix hearing of the case because he is left with a few weeks within which to conclude his session.

According to the evidence that the prosecution intends to rely on,   Kanyamunyu is said to have been driving along with his lover Munwangari on the fateful night before he  got into a quarrel with  Akena whom he accused  of scratching his car.

Evidence further shows that Kanyamunyu shot Akena three times in the stomach and that later the couple played a Good Samaritan by rushing   him to Novirk Hospital on Bombo road where he died from.

However, prosecution also contends that health workers at Norvik hospital who interacted with Akena shortly before his demise claim he mentioned Kanyamunyu as his killer.

His elder brother, Joseph Kanyamunyu is however charged with being an accessory to the said murder and the   prosecution contends that he was called by his brother at the scene of crime, picked   the killer gun from the vehicle and hid it in order to conceal evidence.

The trio has since denied the charges and are out on bail awaiting the the case to be fixed in the next session.
