14 year old boy sues Infectious disease institute for circumcising him without his consent

A 14 year old boy has dragged the Infectious Disease Institute in Kampala for circumcising him without his consent and later the act turned sour as the wounds became septic.

Through his older friend, the 14 year old toddler  says in a suit filed at the High Court in Kampala that between June 15 and 23 2017 while still a pupil of Kalangala Primary School in Kakumiro , the workers from the Infectious Disease Institute assumed a duty of circumcising him without consent of his parents.

“I informed them (IDI) that my parents were not in support of the action but they insisted and argued that they were executing government orders to circumcise all male children,” the 14 year old  says in his affidavit.

“They forcefully did it and later warned me against telling my parents about the said action and promised me more bottle of juice and biscuits.”

According to the affidavit, workers from the Infectious Disease Institute neglected their duty to treat the boy of the injuries they had unlawfully inflicted on him causing the wounds to turn septic.

“The parents got to know about the unconsented circumcision when he could no longer move due to the severe swelling of testicals and penis; too much pain and pass flowing out of the penis.”

The 14 year old boy contends that due to the negligence of the IDI to attend to him despite several requests and the pain that he went through, his parents took him to a private clinic for medical attention.

He further argues that the injuries inflicted on him were due to trespass done to his body and negligence by the Infectious Disease Institute.

Damages

The boy seeks compensation for the damage, torture and financial loss occasioned onto him by the unlawful actions by the IDI.

“I ask court to declare  that the Infectious Diseases Institute actions  or omissions were unlawful   and order for compensation  and damages arising from assault, battery, torture and permanent injuries caused and the negligence of the IDI ,”says the civil suit.

The court registrar has since ordered the Infectious Disease Institute to file a defence within 15 days from the date of service of the suit filed on May 24.
