The High Court in Kampala has ordered security agencies to produce Eddy Ssebuufu also known as Eddie Mutwe, a bodyguard to Kyadondo East Member of Parliament Robert Kyagulanyi, dead or alive.
Early this week a lawyer petitioned the Civil Division of the High Court in Kampala seeking for orders to the Chieftaincy of Military Intelligence (CMI ) ,the attorney General and the Chief of Defence Forces in the UPDF Gen David Muhoozi to immediately produce Mutwe in court .
Anthony Kusingura of Kiiza Mugisha Advocates in a habeas corpus filed on Tuesday said that Ssebuufu was allegedly kidnapped or arrested by operatives from the military on August 25 from Ssemakokiro plaza in Kamwokya within Kampala and detained in an unknown place.
A habeas corpus application is made while seeking a person under detention to be brought before a judge or magistrate mainly to secure that person’s release unless lawful grounds are shown to justify their continued incarceration.
On Thursday, High court judge Musa Sekaana ordered security agencies to produce Sebuwufu not later than September 4.
In his order, the judge ordered Chieftaincy of Military Intelligence, the attorney General and the Chief of Defence forces Maj. Gen David Muhoozi to immediately produce him in court .
"The continued detention of Eddie Ssebuufu without producing him to court has deprived him of his fundamental human right to liberty and contravenes the 48 hours rule,"said the judge.
This comes on the backdrop of Gen.Muhoozi denying that the army arrested Kyagulanyi’s bodyguard over any matter.
“Why would we arrest Bobi Wine’s bodyguard,”Gen.Muhoozi wondered on Saturday during a press conference in Naguru.
Police has also denied detaining Ssebuufu.
“The police has not arrested Eddy Mutwe as alleged by social media platforms. If he is missing, we advise that the family immediately reports disappearance of their family member to the nearest police station for efforts to find him,” police spokesperson Emilian Kayima said recently.
Following the chaos in Arua that saw President Museveni’s convoy allegedly stoned two weeks ago, over 34 people including MPs Kyagulanyi, Paul Mwiru, Kassiano Wadri and Gerald Karuhanga were arrested.
They were later charged with treason for throwing stones at the convoy with an intension of harming the president but have since been released on bail.
