It’s over for Raila Odinga; Uhuru is president of Kenya

The Kenyan supreme court has declared Uhuru Kenyatta the validly elected president of the Republic of Kenya following a repeated election on October 26.

The Court dismisses two petitions challenging the October 26 repeat election, Judges unanimously say Uhuru Kenyatta was validly elected.

“Having carefully considered the above issues, the specific prayers in each petition as well as the constitution and the applicable laws, the court has unanimously determined that the petitions are not merited,” Maraga ruled.

“And the final orders pursuant to article 140 sub article 2 of the constitution as read with rule 22 of the supreme court presidential election petition rules are as follows; Petition number two of 2017 by Hon John Harun Mwau Vs the IEBC and two others as consolidated is here by dismissed,” he ruled.

John Mwau dragged the IEBC to court for allegedly holding the repeat of the election in violation of the constitution. Mwau says after the August 8 election results were nullified by the Supreme Court, the IEBC should have conducted nominations before ordering the rerun.

“Petition number four of 2017 Njonjo Mue and another vs Chairperson of IEBC and three others is also here by dismissed, as a consequence, the presidential election of 26 October is here by upheld as is the election of the third respondent, each party shall bear its own costs,” Maraga concluded.

Njonjo Mue, the chairman of the International Commission of Jurists ran to court seeking the nullification of Uhuru’s election. Mue argued that the fresh poll was not held in strict conformity with the Constitution, the applicable laws, and as directed by the September Court on September 1.

The verdict by supreme court ensures the opposition Chief Raila Odinga will have to seek new means to unseat Uhuru Kenyatta. Raila however remains tight lipped on his next course of action.

Uhuru Kenyatta was announced president elect in the October 26 repeated election in which he garnered 7,483,895 votes representing 98.26%.
