Sir Apollo Kaggwa sued for Shs1Bn over kid who died at school mysteriously

A parent has dragged Sir Apollo Kaggwa Primary School in Nakasero to court demanding for a one billion shillings compensation over the death of his five-year-old son under mysterious circumstances at the school.

Last month, Imran Ssentamu, a Top class B pupil, died at the Case Hospital, where the school authorities had rushed him after a suspected fall at the school located on Nakasero Road.

In a suit to the civil division of the High Court, Martin Ssentamu, the father to the deceased pupil claims that on July 25, 2019, while in his classroom, his son, was hit by a loose frame of timber that had a thick layer of granite affixed on it.

“As a result of being hit by the heavy frame of timber, the deceased obtained blunt force trauma injuries that led to his death about an hour after the incident,” the deceased’s father avers.

“The deceased had been in good health and had no medical complications that were known to the parents before he met his demise.”

Negligence

Ssentamu says that the school ought to be held accountable for negligence that saw them fail in their duty to take any adequate precautions for the safety of his son and other pupils at the school premises.

“Keeping loose frames of timber in a classroom on the school premises well knowing that they pose a danger to the lives of pupils was illegal.”

The deceased’s father contends that the conduct of the school management showed all signs of negligence as is liable for general and punitive damages.

Ssentamu also says the school owed the decceaed a duty of looking at him well together with other pupils but they failed.

“The death caused me and my family excessive emotional distress, mental anguish and the younger sibling of the deceased who was also a pupil at the school was so traumatized that he has since refused to return to the same school.”

Damages

The parent now demands for shs950 million for general damages and shs50 million for punitive damages for the loss of his son.
