Court upholds MP Ekanya's victory

High Court in Mbale has dismissed with cost two election petitions filed against Tororo County North MP Godfrey Ekanya FDC and Agule County MP Polycap Ogwari Independent on grounds of defective affidavits.

Ekanya's victory was challenged by his predecessor and contender Annet Nyakecho NRM while Ogwaris was challenged by David Ochwa NRM on various grounds of election malpractice. Ochwa further challenged Ogwari's academic qualifications.

Justice Andrew Bashaija found that the petitioners' affidavits were irregularly commissioned by one Raymond Rwakikoru who had no practicing certificate at the time of commissioning oaths for both petitioners.

The judge's decision followed preliminary objections by the council for the defendants over the same.

Ekanya's contender Annet Nyakecho conceded defeat and blamed the loss on her legal team for not doing due diligence. She was not clear on her next course of action.

This brings the total number of dismissed cases to 4 out of 31.

Others include Watila Wilson vs Wanendeya David Wakikona, Bukigayi county; Balunywa Sumaya Aliza VS Bernard Odoi & Electorol Commission for Eastern Youth MP.
