Army still investigating businessman Buchanan for illegal possession of a gun

The army prosecutors have told the General Court Martial in Makindye that they are still investigating city businessman Sam Buchanan who was arrested last month.

Buchanan was arrested by the Chieftaincy of Military Intelligence (CMI), the army’s intelligence wing in connection with fraudulent gold dealings before being charged with unlawful possession of a firearm and its ammunition and remanded to Kigo government prison.

On Tuesday, when the case returned to court for mention, the state prosecutors said investigations into the matter are still ongoing.

“The accused was charged with illegal possession of a firearm and ammunition on August 20th and remanded but investigations into the matter are still ongoing. We ask for an adjournment to allow investigations be completed,” Lt. Col. Raphael Mugisha, the lead army prosecutor told court.

The army court chairman, Lt.Gen.Andrew Gutti adjourned the matter to September 23, 2019.

Buchanan was arrested two weeks ago from his home in Muyenga when operatives attached to CMI invaded his home over allegations of being involved in fake gold deals where a number of people, especially foreigners have been conned of huge sums of money.

He was arrested together with two other people but these have never been arraigned in court.

The charges

Buchanan is accused of illegal possession of a gun contrary to section 3(1) and 2(a) of the firearms act 299.

Prosecution alleges that on August 16, Buchanan, 49 and a resident of Buziga was found in possession of a pistol which is ordinarily a monopoly of the defence forces.

He was also charged with illegal possession of 18 rounds of 9mm caliber live ammunition for the pistol he was found with.
