In a case filed as Miscellaneous Case No. 31, Besigye’s legal team has demanded that both Attorney General Kiwanuka and Uganda Prisons Chief Johnson Byabasaija appear before the Supreme Court to explain the continued detention of the accused.

The legal team, led by Kenyan senior counsel Martha Karua and Kampala Lord Mayor Erias Lukwago, also wants the Attorney General and the Commissioner of Prisons to be summoned to explain the legal basis for keeping Besigye and Lutale in prison despite the ruling that annulled military court proceedings against civilians.

The ruling, delivered on January 31, marked a significant victory for human rights defenders who have long criticized the military court’s role in prosecuting civilians.

This long-awaited decision stems from a 2021 appeal filed by the Attorney General after the Constitutional Court declared the trial of civilians in the General Court Martial unconstitutional.

The GCM subjected him to a summary sentencing of nine months in Kitalya Prison for alleged contempt of court. This sentence, we contend, was premeditated and aimed at provoking us into actions that would justify primitive sanctions

In a ruling delivered on Wednesday evening, Brigadier-General Robert Freeman Mugabe, the chairman of the GCM, asserted that his court has the power to try anyone charged with treachery, regardless of whether the alleged offence occurred within or outside Uganda.

The amended charges now include a third defendant, Captain Denis Ola, a serving UPDF officer from the Armoured Brigade, who has been brought into the case, also facing the same charge of treachery.

The military prosecutor, Colonel Raphael Mugisha, started the day by requesting the court to we allow amendment of the charge sheet, adding a one Capt Denis of the Armoured Brigade to the case

The previous session of the court martial was marked by dramatic events when lawyer Eron Kiiza was arrested inside the courtroom.

The General Court Martial on Tuesday sentenced Mr Kiiza, one of the lawyers representing Dr Kizza Besigye, to nine months in prison after finding him guilty of contempt of court.
