Mubende Court Dismisses Kassanda North Vote Recount Petition

The Mubende Magistrate Court, presided over by Chief Magistrate Noorbert Ssajjabi, has dismissed an application seeking a vote recount for Kassanda North Constituency.

The petition was filed by NRM flag bearer Isaac Kamulegeya, challenging the declaration of NUP incumbent Patrick Nsamba Oshabe as winner.

According to official results, Nsamba Oshabe secured 12,274 votes, while Kamulegeya polled 12,158 votes, leaving a slim margin of 116 votes.

In his ruling, Chief Magistrate Ssajjabi held that Kamulegeya failed to provide sufficient evidence to justify a recount.

The court agreed with submissions by Aziz Kayondo, counsel for the Electoral Commission, who described the petition as a “fishing expedition” and cautioned against granting it.

Kamulegeya had alleged that his polling agents were denied access to Declaration of Results (DR) forms at several polling stations, including Kabaale Church of Uganda, and parishes of Kasasze, Kikandwa, Nakatete, and Dalamba.

However, the court found these claims unsubstantiated and insufficient to overturn the declared results.

The dismissal of the petition effectively upholds Patrick Nsamba Oshabe as the duly elected Member of Parliament for Kassanda North Constituency.
