Time Limit? Mabirizi wants Chief Justice to explain Age Limit appeal judgment delay

Lawyer Male Mabirizi and one of the appellants in the age limit petition has demanded an explanation from judges of the supreme court over delay in delivery of the appeal judgment beyond the provided for 60days.

Mabirizi who wants to seek justice at an international level says the delay has allowed President Museveni who is the key individual of contention to declare himself as sole candidate in the NRM.

Mabirizi delivered a notice addressed to the Registrar of the Supreme Court Anguardia Opefeni and the Seven (7) justices who heard the appeal demanding explanation for the delay.

In this, Male says he is not interested in the judgment anymore but tasks the Chief Justice to give him explanation as to why they have been unable to deliver their ruling within the provided for 60days.

According to his statement: "The sixty days expired on 16th March 2019 but even up to now, I have not received the required good reason for your failure to deliver the verdict yet you being the apex court, ought to have notified me of such reason, if any."

Mabirizi is frustrated that the alleged delay has left loops that have been manipulate by the ruling government who have already declared Museveni a sole candidate for the NRM.

"This court has denied us justice by delaying to give judgment yet at the same time Mr Museveni is going ahead to declare himself a sole candidate as if there is nothing to challenge his term, yet we came here to challenge his standing."

In the letter Mabirizi says, the delayed judgment leaves him to suffer the very frustrations he suffered at the Constitutional court.

"The delay has partially negatively determined my appeal because one of my objections to the constitutional court decision was the delay to deliver judgment meaning that since you have delayed, that part is lost."

The Age-limit appeal judgment has been pending for 71 days and the mandatory 60 days within which court should deliver the same expired on the 16th/March 2019.

The appeal arose from a majority Constitutional court verdict which upheld Constitutional amendments regarding the lifting of a cap from the minimum and maximum presidential age.

Chief Justice Sick

The Chief Justice, Bart Katureebe is unwell, multiple sources within the judiciary have told The Nile Post.

Sources told us that Katureebe, the head of government’s third organ, was flown out of the country early this month to South Africa where he had a minor surgery for an undisclosed ailment.

Katureebe returned to the country on Monday but sources told us he is still evidently unwell.

For close to a month Owiny Dollo, his deputy, has been acting chief justice.

Sources told us that Katureebe’s illness has become a matter of concern amongst his colleagues especially because the judiciary preferred to keep it a secret.

“Usually when the chief justice travels out of the country, he makes an official communication but this time nothing was said,” one of the sources told us.
