New bill to regulate court bailiffs

The Parliamentary Committee on Legal and Parliamentary affairs has inserted a new provision in the security interest in movable property bill 2018 that will regulate the operations of court bailiffs in the country.

The Chairperson of the Committee Jacob Oboth Oboth also says the bill that is ready for presentation before parliament, will provide for the use of movable property as collateral for credit and perfection of security interests.

Court bailiffs are law enforcement officers whose main role is to maintain order during courtroom proceedings, enforcement of court orders among others. But of recent the role of Court bailiffs has come under the spot light with their involvement increasing alleged illegal evictions.

The activities of the court bailiffs soon are going to be checked with the new provision in the Security interest in movable property bill 2018 that will regulate the operations of court bailiffs in the country.

The bill will determine the time of the execution of the court order, the qualifications of the court bailiffs among others.

According to the Chairperson of the Committee Jacob Oboth Oboth, the bill will also provide for the use of movable property as collateral for credit and perfection of security interests.

Oboth Oboth also disclosed on how the committee has finalized processing the Administration of Judiciary bill 2018 that will give more powers to the Chief Justice, define the retirement package of Judges among others.

The Bill will also make the third arm of Government Judiciary an independent entity away from the Ministry of Justice and Constitutional affairs.
