Agnes Napiyo the interdicted grade one magistrate at Nakawa chief magistrates’ court who was arrested and charged with corruption has asked the anti corruption court to dismiss her case following delays from prosecution.
While appearing before grade one magistrate Patricia Amoko, Napiyo through her lawyer Dennis Nyombi asked court to dismiss the matter against her arguing that continued absenteeism from the prosecution is infringing on her rights and freedom to a speedy trial.
Her lawyer Nyombi noted that it’s unfortunate that the matter hasn’t started.
“Since April there is no progress in the case, which is an infringement on the rights of the accused.”
Nyombi added; “We have asked court to dismiss the matter and whenever state is ready, the same can be reinstated.”
Napiyo who is frustrated by the delays says “the matter was fixed for hearing in July but there has been no hearing because of dilly dallying by the prosecution.”
“Prosecution has even failed to disclose available evidence up to this date that was set for hearing,” she said.
Court therefore made a final adjournment to January 25 and if state doesn’t return to court, the same will be dismissed.
Napiyo, a grade one magistrate at Nakawa Chief Magistrates’ court is battling charges including abuse of office and corruption. State alleges that between March 2 and April 2017 at Nakawa Chief Magistrates Court, Napiyo corruptly solicited for shs1 million and received sh700,000 from a one Vincent Amam Egesa as an inducement to reverse a child custody ruling in his favor.
