Kitatta's wife drags Kayihura to court
The wife to Boda-Boda 2010 chairman, Abdullah Kitatta has dragged the Inspector General of police Gen.Kale Kayihura and the Chief of Defence Forces Gen David Muhoozi to court seeking orders to have her husband produced dead or alive.
Sumayya Ninsima a resident of Masanyalaze zone in Lubaga division says she does not know the whereabouts of her husband who was arrested on January 20 following a sting operation by the army and security agencies on Boda Boda 2010.
“I only learnt from the print and electronic media that my husband was arrested by the UPDF at his offices in Wakaliga in a joint operation with the police force and other security organs,” Ninsiima says in her affidavit in support of the application for a habeas corpus.
“According to one Lt.Col.Deo Akiiki,the deputy army spokesperson, the applicants and other suspects were detained at Kireka police station pending further investigations.”
Under Ugandan laws, suspects are supposed to be produced in court not more than 48 hours after arrest. Kitatta has been in detention since January 20.
In a press statement released on Sunday, the army said that the 30 suspects arrested over the murder of Francis Ekalungar, the Case hospital accountant who burnt body was found at Kajjansi and detained at Special Investigations Unit in Kireka.
However, Kitatta’s wife claims that efforts to trace him at Kireka have proved futile as she was told that he had never been brought at the facility.
“I was informed that he (Kitatta) was not in Kireka before being told that I should check with the UPDF CMI headquarters in Mbuya and when our lawyer Joseph Kiryowa went to Mbuya, he was directed to first seek permission from the Chief of Defence Forces," she notes in her application.
The wife contends that since his arrest last week, Kitatta has been held incommunicado and has never been produced in any courts of law, neither have any charges been slapped against him.
Ninsiima says she now wants court to compel Gen.Kayihura and Gen.Muhoozi as the heads of both the police and army to be compelled through a habeas corpus to produce the Boda Boda 2010 chairman, Abdalla Kitatta dead or alive.
“I believe his detention is unlawful and unjustified thereby requiring the intervention of this court,” Ninsiima says in her affidavit dated January 24.
The army said on Sunday that investigations into the activities of Boda Boda 2010 are still ongoing.
